The content published on this website, including text, images, video content, infographics, social media content, and all other materials ("Content"), is provided for general informational and educational purposes only. The Content is not intended to be, and does not constitute, medical advice, diagnosis, treatment, or a substitute for professional medical consultation.

DO NOT RELY ON WEBSITE CONTENT FOR MEDICAL DECISIONS. The Content does not account for your individual circumstances, medical history, medications, allergies, or other factors that a qualified healthcare provider would consider during an in-person evaluation.

Always seek the advice of a qualified, licensed physician, chiropractor, or other healthcare professional regarding any medical condition, treatment plan, or health concern. Never disregard or delay seeking professional medical advice because of information you read on this website.

MEDICAL EMERGENCY: If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do not use this website to obtain emergency medical assistance.

2. No Provider-Patient Relationship

Use of this website, submission of a contact form, receipt of an automated response email, or any communication initiated through this website does NOT create a provider-patient relationship between you and Elite Performance Institute San Diego, Dr. Peter Mackay D.C., or any other clinician or staff member associated with Elite Performance Institute San Diego.

A provider-patient relationship is established only after:

  • Completion of a formal intake and registration process at our clinic
  • A formal clinical evaluation by a licensed clinician
  • The clinician's express acceptance of you as a patient

Until a formal provider-patient relationship has been established, information exchanged through this website is not subject to any professional duty of care, confidentiality obligations beyond our Privacy Policy, or HIPAA protections.

3. Professional Services Disclaimer

Elite Performance Institute San Diego provides licensed chiropractic care and sports medicine services in the State of California. Our services are provided under applicable California licensing requirements and are subject to applicable standards of care.

All clinical services are performed by, or under the direct supervision of, duly licensed healthcare professionals. However, healthcare is not an exact science and individual results vary significantly based on many factors outside any clinician's control, including but not limited to patient adherence, underlying health conditions, mechanism of injury, and individual physiology.

No Guarantee of Results: Nothing on this website constitutes a guarantee, warranty, or promise of any specific clinical outcome. Testimonials, case studies, or success stories (if any) reflect individual experiences and are not representative of typical results.

4. Assumption of Risk — Physical Activities

Chiropractic care, physical rehabilitation, therapeutic exercise, and related services involve physical contact and physical exertion. All physical health activities carry inherent risks, including the risk of injury or aggravation of pre-existing conditions.

By engaging in our clinical services or following any recommendations provided by our staff, you acknowledge and accept that:

  • You have voluntarily chosen to participate in clinical care and related physical activities
  • You have disclosed all relevant medical history, current conditions, and medications to your treating clinician prior to commencing care
  • You understand that chiropractic adjustments and manual therapies involve physical forces applied to the body and carry risks including temporary soreness, rare risk of adverse events, and other outcomes
  • You will inform your treating clinician immediately of any pain, discomfort, or unusual symptoms during or after treatment
  • You assume personal responsibility for any and all risks, known and unknown, arising from participation in clinical services

Medical Clearance: Individuals with pre-existing cardiovascular conditions, bone density disorders, recent surgeries, bleeding disorders, or other significant health concerns should obtain written clearance from their primary care physician prior to initiating care at Elite Performance Institute San Diego.

5. Personal Injury Documentation

Elite Performance Institute San Diego provides clinical documentation services for personal injury cases, including workers' compensation and automobile accident cases. Such documentation reflects the clinical findings, professional opinions, and treatment records of treating clinicians and is governed by applicable standards of professional practice.

Clinical documentation prepared in connection with legal proceedings is provided as a professional clinical service and does not constitute legal advice. For legal strategy, case management, and legal representation, you must consult a licensed attorney.

Results in personal injury cases are determined by numerous factors beyond clinical documentation, including liability, insurance policy limits, comparative negligence, and other legal considerations. Elite Performance Institute San Diego makes no representation regarding the outcome of any legal proceeding.

6. Telehealth and Remote Communications

Elite Performance Institute San Diego may provide limited health-related information through electronic communications, including email, contact form responses, and digital messaging. Such communications are informational only and do not constitute telehealth services, clinical consultations, or provider-patient communications unless expressly designated as such and conducted through a HIPAA-compliant telehealth platform.

Future telehealth services, if offered, will be subject to separate consent, disclosure, and informed consent documentation as required by California telehealth law (California Business and Professions Code §§ 2290.5) and applicable federal regulations.
